' This is a revision petition filed under section 13 of the Consolidation of Holdings Ordinance, 1960, against the order dated 3-10.1973 of the Addl. Commissioner (Cons ), Multan, whereby the appeal of the petitioners was dismissed.
2. I have heard the petitioners on the following points :
(i) Petitioners' land measuring 56K-16M has been taken away from them, and respondents' land measuring 52 kanals has been allotted to the petitioners.
(ii) Barren land has been allotted to the petitioners.
(iii) Possession of the parties has not been kept in view while framing the consolidation scheme.
3. The record shows that the petitioners have been allotted land in each class of soil according to their entitlement as far as possible. The total entitlement of the petitioners was 60K-12M in terms of class I. They have now received 62K-13M in the same class in Khata No, 265. Thus the petitioners have been allotted 2K-1M in excess of their entitlement. They have also received more area in Class I than they were entitled to 45K-9M as against 40K-15M before consolidation. The contention of the Petitioners that they have been allotted barren land is, therefore, no correct.
4. However, I find that Khasra Nos. 3, 4 and 5 of Square No, 55 which belonged to the petitioners before consolidation have been allotted to Muhammad Siddique, predecessor-in-interest of respondents Nos. 2 to 10 at Scheme No, 253 while Khasra No, 24/2 of Square No, 34 and Khasra Nos.
11, 12, 19 and 20 of Square No, 35 which have been allotted to the petitioners belonged to Muhammad Siddique of Scheme No, 253. It would have been better if Khasra Nos. 3, 4 and 5 of Square No, 55 were allotted to the petitioners in lieu of Khasra No, 24/2 of Square No, 34 and Khasra Nos. 11/12, 12, 19/2 and 20-min of Square No 35. 4 therefore allow Khasra Nos. 3, 4 and 5 of Square No, 55 (24 kanals) to the petitioners of Scheme No, 263 and Khasra No, 34/2 (3K-4M) of Square No, 34 and Khasra Nos. 11/2(2K), 12(8K), 19/2(4K) and 20-min Snarqi (7 kanats) of Square No, 35 to respondents Nos. 2 to 10 who are the legal heirs of Muhammad Siddique of Scheme No, 253. This change will also reduce the number of plots allotted to the respondents. As the respondents referred to above are not present the Assistant Collector concerned is directed to hear both the parties while sanctioning the mutation in pursuance of this order.
