MIAN SAQIB NISAR, J.- - The respondents- Department, advertised the posts for the recruitment of the Patwaris for District Lahore, which envisaged 25% quota for the sons of the retired Patwaris. The petitioner, being the son of retired Patwari, submitted the application, in which, he clearly mentioned that his father Karim Khan was Patwari, who had retired on 18.3.2002 and thus, be is entitled to be appointed as Patwari. Anyhow, the petitioner was interviewed and thereafter", his name did not appear either in the list of the quota reserved for the sons of the retired Patwaris, or on the general post. He again made a representation on 18.10.2003, submitting that his name has been omitted without any justification from the said list. Fob the appointment of Patwaris. On this application* no action was taken by the respondents-Department, hence the present petition.

Learned Assistant Advocate-General, and the Settlement Officer (respondent No. 2) present in the Court state that, the petitioner had not appended alongwith his application any proof of his being the son of retired Patwari; he was asked a question while being interviewed, yet no proof was produced, therefore, he was not considered in this category.

I am afraid, that this plea on the face of it, seems to be ridiculous, because nothing in writing was sent to the petitioner to give the proof about the retirement of his father, when it was mentioned in his application with reference to the name and . Also the date of retirement of the petitioner's father. If the respondents were dissatisfied about it, they could have asked the petitioner in writing to prove the same. The verbal inquiry in this regard has no legal value.
4. The learned A.A.-G. States that, the petitioner till to date, has not produced the requisite documents to prove that, he qualifies in the special quota. I have perused the record and find that, the copy of the Pension Payment Order Book of the petitioner's father is on the record. To respondents-Department can take the particulars from this and verify the same. Besides, the petitioner shall also submit all the necessary documents, which the respondents-Department requires, within one week. Subject to the verification, that the petitioner's father is a retired Patwari, and the other qualification if any, the petitioner shall be appointed, because I am told that, out of 23 seats reserved for the sons of retired Patwaris, only 1 8 seats have been filed, whereas 5 seats have been allocated to the general quota, which could only be done if, the reserved quota was not fulfilled. But due to the nonconsideration of the petitioner, one of such seats could not have been allocated to the general quota. Resultantly, by allowing this petition, it is directed that, the petitioner shall be considered against one of the posts reserved for the retired Patwaris' sons and if, the petitioner qualifies for the post, it shall not be considered to have ever been part of the general quota.
