ORDER

IMASIM SABIR CHAUDHARY, J - Contends that the petitioner had approached the learned Sessions Judge for registration of the case, but his application had been disposed of with the observation that as the DPO had already directed the SHO Police Station Sadar Arifwala to conduct investigation of this case afresh and submit his report to him. In view of direction of DPO, no further action was required on this application. Learned counsel had relied upon 1999. P.Cr.L. J. 1645, wherein it had been held that no preliminary inquiry could be conducted, before registration of a case.

2. In this view of the matter, the petitioner is directed to submit a fresh application before the SHO Saddar Arifwala, who will receive the same and if the contents of the application disclose the commission of any cognizable .Offence, then, register the case and proceed further in the matter, strictly in accordance with law, in view of provisions of Section 154, Cr.P.C.
