' MAULVI ANWARUL HAQ, J. This is an application seeking refund of amount incurred on payment of court-fee on memorandum of appeal. We find that this appeal was admitted to regular hearing on 12-9-2000. Thereafter it was taken up on 23-12-2003 when a compromise was recorded and the appeal was dismissed as withdrawn in the light of the said compromise. To our mind the request is covered by judgment of the Honourable Supreme Court passed in case Sh. Riaz ud Din v. Aqil ur Rehman Siddiqui and 4 others PLD 1993 SC 16.
2. The application is accordingly allowed. Office to issue refund certificate to the appellant.
