ORDER

Akhtar Gul and Mst. Asal Marjana both son and daughter respectively of Arab Gul deceased are present and state that they have received Rs,4,00,000 (Rupees four lacs) as compensation from Hameed Khan petitioner/accused. They also state that out of aforesaid amount Rs,3,00,000 (Rupees three lacs) are the share of son and Rs,1,00,000 (Rupees one lac) of the daughter. Both the legal heirs specifically admitted before us that they have received their respective shares.

According to the report of learned Additional Sessions Judge, Mianwali, compromise entered between the parties is genuine.

2. Keeping in view, the report of Additional Sessions Judge, Mianwali and the admissions made before us by above named legal heirs of the deceased, the compromise is accepted and petitioner/accused Hameed Khan is acquitted under section 345, Cr.P.C. The petition is converted into appeal and the same is allowed.
