ORDER

C.M. NO,1329-C OF 2002 ' Learned counsel for the appellant and respondent No,1 have jointly filed this application, today, in Court, which has been numbered.

2. Aforenoted application has been filed under Order XXIII, rule 3, Civil Procedure Code by the aforesaid parties with the prayer "that the titled appeal may very kindly be disposed of in terms of the compromise submitted in para. 3 above". Let the main appeal be taken up, which is also fixed for today.

Main Case

3. Learned counsel representing the appellant and respondent No,1, while reiterating the contents of the aforementioned application (C.M. No,1329-C of 2002), have jointly requested for recording the compromise, entered into between the aforesaid parties, and for the disposal of the present appeal in terms of the compromise as elaborated in para. 3 of the application.

4. It is stated by the learned counsel, representing the A said parties, that they have settled the dispute, through an amicable settlement arrived at between the parties and the said agreement has been entered into, whereby the appeal as a whole has been adjusted through a lawful compromise.

5. In the above background the learned counsel for the said parties have jointly requested that the present appeal may be disposed of in terms of the compromise recorded in para. 3 of the application.

6. In the above perspective and consequent to the filing of the aforenoted application, containing the terms of the compromise in para. 3, and in view of the joint request of the learned counsel for the parties the compromise is accepted, which is to the satisfaction of this Court lawful and adjusts whole of the claim, the same is hereby recorded and made part of today's order.

7. Consequently, the present appeal stands disposed of as per the terms and arrangements, agreed to between the appellant and respondent No,1, as incorporated in para.3 of the aforenoted application, which is marked as "A". Para.3 of the application containing the terms of the compromise shall be considered as integral part of today's order.
