' Through this Constitution petition, the petitioner Bisharat Ali Shahzad seeks a direction against respondent No.3 for admitting him in B.Sc class.

Brief facts of the case are that the petitioner appeared in the Intermediate Examination Part-II (Combind) Annual Examination 2002 but unfortunately failed in two major subjects i.e. Economics and Mathematics. Thereafter, the petitioner appeared in Supplementary Examination of Intermediate Part-II (Combind) 2002 and has been declared successful. The petitioner applied for admission in the 3rd Year class in Government Science College, Multan but the respondent No.3/the Principal refused to admit the petitioner in the 3rd Year class, hence, this constitution petition

The learned counsel for the petitioner submits that in the Identical cases where the students had failed in one subject in the Annual Examination and had passed their said subject in the 2nd Annual, they have been allowed admission in the 3rd year class while the petitioner has been discriminated illegally.
4. The report and parawise comments were called for from the University. As per University Regulation titled as "Admission to B.A./B.Sc/B.Com. Ist Year class for the Academic Session 2002- 2003" only those students can be provisionally admitted in the B.A./B.Sc/B.Com in the 3rd year class, who have failed in one subject in the Annual Examination but their admission shall be regularized in case they qualify the said subject in the supplementary Examination. The petitioner's case is clearly hit by the said regulation as he had failed in 2 subjects hence the refusal of admission to the petitioner is in accordance with the University Regulation. There is no illegality or irregularity found whereby the petitioner has been refused admission in the 3rd Year class.
' In view thereof, this petition being without merit is hereby dismissed.
