1. ' This is a revision application under sections 435, 424 and 561, Cr. P. C. Against the order of S. D. M.
2. City Hyderabad, passed under sections 112 and 117(3), Cr. P. C., in proceedings under section 110, Cr.
3. P. C. Started against applicant Yar Muhammad alias Yaru on the report of S. H.
0. City Police, Hyderabad. The allegations against the applicant were that he was habitual thief and receiver of stolen property and he disposed of the same on payment of bhung and that he harboured thievs and was a desperate and dangerous person. In all 6 witnesses were cited out of whom 4 were police officers. The remaining 2 witnesses from the public were Abdul Latif and Muhammad Hassan. These witnesses have been examined by the learned S. D. M. In the course of this enquiry and both say that they do not even know the person proceeded against and they were called at the police station and were forced to give evidence in this case but they know nothing.
4. ' The learned Asstt. A.-G. Mr. Osman Ghani has referred to this evidence even at this hearing. For grant of bail, and he has moved this Court to dispose of the entire proceedings. He has pointed out that since the only two independent prosecution witnesses have not supported the case of the prosecution, no reliance could he placed on the opinion of the police officer cited in this case and no useful purpose therefore, will be served if the proceedings are allowed to be continued in the Court of the learned S. D. M.
5. ' Under the circumstances the main petition is allowed and the proceedings as well as orders passed under sections 112, 117 (3), Cr. P. C. Are hereby quashed. Applicant Yar Muhammad who is in custody may be forthwith released if not required in any other case.
