1. 'The learned counsel for respondent No,1 has made an offer that a sum of Rs,14,400 pertaining to the share of rent of his client at the rate of Rs,800 per month and for the period from 7-6-2000 to December, 2001, may not be deposited by the petitioner before the trial Court until the question whether the tenancy went in abeyance because of a partnership between the said respondent and the petitioner as determined by the trial Court provided a surety bond is submitted before the trial Court for payment of this amount at the time of the passing of the final order by the Rent Controller. Learned counsel further prays that the Rent Controller be directed for expeditious disposal of this case.
2. ' Learned counsel for the petitioner accepts this proposal without I B prejudice to the ultimate result of the case.
3. ' Consequently the matter is disposed of.
4. ' The parties are directed to appear before the learned trial Court. The trial Court is directed to dispose of the case with convenient despatch and preferably within four months from today.
