Ghulam Haider complainant filed a complaint under section 325/34, P. P. C. Against the petitioners.
Process was issued against them on 1-10-1976. They moved an application for bail before Magistrate 1st Class, Chiniot but the same was dismissed on 18-10-1976. They also moved a petition for bail before the learned Sessions Judge, Jhang but the same was also dismissed on 29-10-1976.
2. The learned counsel for the petitioners submits that the injuries on the person of Dost Muhammad injured P. W. Were simple in nature and section 325, P. P. C. Is not attracted. He further submits that even otherwise the petitioners are behind the bar for the last about two months. The order of the learned Sessions Judge shows that injuries Nos. 1 and 4 on the person of Dost Muhammad were kept under observation and the result was not A available till 29-10-76. The learned State Counsel submits that he is not in a position to say anything about the result of these two injuries. The other three injuries on the person of Dost Muhammad were found simple in nature.
In the circumstances I admit the petitioners to bait in the sum of Rs, 5,000 with one surety each in the like amount to the satisfaction of trial Magistrate, Chiniot.
