1. Record has been perused. On 27-6-1977 the learned Sessions Judge, Sargodha recorded the following order : "Case be registered and put-up on its turn for hearing."

There is no other order passed thereafter, which means that uptil now the petitioners have never been produced before the learned Sessions Judge noA the Presiding Officer passed any order of remanding them to the judicial custody. If in the meantime the case had been fixed for trial, there could be some scope to say that since no time limit is given in section 344, Cr. P. C. For which the cases may be adjourned, the detention was not illegal but since during the period of 7 months the case has not been fixed for trial nor the petitioners were ever produced before the learned Sessions Judge, it cannot be said that still the detention is legal. I, therefore, have no other alternative but to accept the petition. The petitioners arc admitted to bail in the sum of Rs, 20,000 each with one surety each in the like amount to the satisfaction of A. C., Sargodha.
