ORDER

Civil Miscellaneous No,526-C of 2002 ' Instant application, filed on behalf of Muhammad Ijaz and Nazia Rafique (respondents Nos.8 and 9 in Civil Revision No,1616 of 2001), under section 12(2), C.P:C., seeks recalling of order dated 20-11-2001, passed by this Court, whereby on the basis of an agreement dated 17-8-2001 (Mark A) revision petition (Civil Revision No,1616 of 2001) was disposed of in terms of the said compromise.

2. Upon the examination of the record of the case, particularly, the agreement dated 17-8-2001, I find that the applicants herein are not the signatories to the said agreement. This fact has even been conceded by the learned counsel for the respondents (revision petitioners). Furthermore, the said compromise was, statedly, entered into between Nasreen Akhtar etc. (Party No,1) and Muhammad Aamir etc., (Party No,2) though the names of the applicants find mention in the said document. Suffice it to say that as the applicants are not the signatories to the said agreement, therefore, they are not bound by the terms of the same, and thus the order dated 20-11-2001 would not operate qua the applicants.

3. Present application stands disposed of with the above observations. Civil Miscellaneous No,2-C of 2002 ' With the disposal of the aforenoted application, the present application has become infructuous, thus disposed of.
