I have been taken through the F. I. R. Of this case. Muhammad lshaq deceased was sleeping at his behak. Akbar Ali complainant was sleeping at his own behak, at a distance of about one killa. On heating the fire shots, he rushed to the spot and found the six petitioners running away from the spot of occurrence. The complainant alleged in the F. I. R. That the petitioners had fired 3/4 shots in the air in order to threaten him. According to the complainant, the petitioners had motive to commit murder on account of previous enmity.
2. The case was investigated by the local police and all the six'A petitioners were found innocent.
There is no fire shot injury on the hod; of the deceased. The complainant and other witnesses had not seen any of the petitioners firing shot at the deceased. The only evidence is that they had seen the petitioners running away from the spot of occurrence. No weapon of offence has been recovered from any of the petitioners. As mentioned earlier, they were found innocent by the local police. Taking all these facts into consideration, I allow bail to the petitioners in the sum of Rs. 10,000 with one surety each in the like amount to the-satisfaction of A. C. Chunian.
