MIAN SAQIB NISAR, J.- Learned counsel for the appellant states, that he has instructions to withdraw this appeal, It is further requested, that as no effective proceedings have taken place in the present matter, therefore, as per the view laid down in the judgment reported as Sh. Riaz-ud- Din v. Aqil-ur-Rehman Siddiqui and 4 others (PLD 1993 SC 76), the amount of Court-fee affixed with the appeal be refunded to the appellant.

As the appeal has come for the first time, and no effective proceedings, at all, have taken place, therefore, in the light of the judgment, mentioned above, the office is directed to issue certificate to the appellant, for the refund of the Court-fee.
