1. ' By this single order we propose to dispose of these two bail Applications being No,644 of 2002 filed on behalf of applicant Hussain Bakhsh Panhwar and-Bail Application No,645 of 2002 filed on behalf of applicants Munir and Manzoor.
2. ' It is the case of prosecution that during a raid about one kilogram Charas was recovered from the possession of each applicant as well as from their co-accused Asif Ali. The learned counsel for the applicants have argued that the case of the applicants stands governed under the rule of consistency as accused Asif All with the similar role under the same circumstances and in the same crime has been granted bail by Division Bench of this Court on 26-9-2002 in Criminal Bail Application No,556 of 2002. Learned counsel have placed on record the said order and also placed reliance on the cases of (1) Gul Hassan Dero v. The State 2000 PCr.LJ 657 and (2) Muhammad Saleem v. The State 2002 M LD 1123.
3. ' Mr. Ali Azher Tunio, learned Assistant Advocate-General has stated that the case of the applicants is identical to that of their co-accused Asif and as such he has no objection if bail is granted to the applicants in view of the rule of consistency.
4. ' We have gone through the F.I.R. Of this case and the order passed in Criminal Bail Application No,556 of 2002. We have also taken into consideration the case-law cited by the learned counsel for the applicants. We see no reasons to disagree with the view taken in Bail Application No,556 of 2002 by another Bench of this Court and following the rule of consistency we are also inclined to grant bail to the applicants Hussain Bux son of Muhammad Paryal Panhwar, Munir son of Allah Bux Soomro and Manzoor son of Khuda Bux Gopang in the sum of Rs, 1,00,000 each and P.R. Bond in the like amount to the satisfaction of the trial Court.
