1. ' This petition has been sent through Jail.
2. The first order of detention was passed by the learned District. Magistrate, Lahore, on 8-3-78 against the petitioner under section 3 of the Maintenance of Public Order Ordinance, 1960. The District Magistrate received information that some Political Groups were likely to start` the demonstrations which might result in disturbance of public peace and maintenance of public order. It was also revealed that the petitioner was closely associated with the aforesaid group and engaged in organizing the said demonstration. The District Magistrate was satisfied that the petitioner was acting in a manner prejudicial to the public safety and maintenance of public order.
2. The petitioner was ordered to be detained for 15 days. The second order of detention was passed on 20-3-78. It was stated therein that the circumstances and situation under which the first order was passed still existed and the incidents of organizing unlawful demonstration had occurred resulting in disturbances of public safety and law and order. The learned District Magistrate was satisfied that the petitioner was likely to act in a manner prejudicial to the public safety and maintenance of public order, if released: The petitioner was ordered to be detained till 22-4-78. The first order of detention was passed on the basis of the report of the Additional Inspector-General of Police, Special Branch, Lahore. It was pointed out in the report that the petitioner had delivered speech at Chowk Lahore Hotel, Lahore, on 30-9-77 ; attended the meetings of P. P. P. Central Executive Committee held on the night between 10/11-10-77 ; had participated in the meetings of Provincial P. P. P. Executive Committee on 4th, 11th and 18-11-77, at Lahore ; also attended the meetings of the P. P. P. Central Executive Committee on 30-11-77 and 1-12-77 ; attended Quran Khawarn proceedings at the residence of Mirza Akram Beg, Lahore, on 8-11-77, at 84-Allama Iqbal Road, Lahore on 2-12-77 and at 3-Racecourse Road on 8-2-78. He attended a reception party at 3- Racecourse Road, Lahore, on 14-2-78 and on 18-2-78. He participated in a reception party at 75, F.
3. C. C. Gulberg, Lahore. Again attended a reception party at Jain Mandar, Lahore, on 21-2-78 ; attended the meetings of the P. P. P. On 24-2-78, at 2-Farid Kot House, Lahore, and on 28-2-78 and 1-3-78 at 31-G-Gulberg, Lahore. It was further reported that he was likely to organize and arrange demonstrations and unlawful processions on the day the judgment against Z. A. Bhutto was to be announced by the Lahore High Court. The learned District Magistrate was justified in passing an order of detention on the basis of the material supplied to him.
4. 2-A. The second order of detention was passed on the report of the Additional Inspector-General of Police, Special Branch, Lahore, dated 2,)-3-78. A list of 30 persons including the name of the petitioner at Serial No, 17 was supplied to the District Magistrate. It was reported that fresh information had become available that P. P. P. Was organizing agitation/ demonstrations on big scale not only amongst the general public but also in the labours and students circles. It was further reported that General Tikka Khan's appearance at Lohari Chowk was a part of the said plan and the incident triggered off acts of violence and vendalism and it was learnt that Malik Meraj Khalid, ex-Speaker, National Assembly, Sh. Muhammad Rafiq, ex-Minister, Mr. Shamim Ahmad Khan, ex-Deputy Speaker, Punjab Assembly Mr. Manzar Masood, ex-Speaker, Azad Kashmir Assembly and Mr. Mukhtar Awan, ex-M. P. A. Of Multan District (all present in Lahore) were organizing a clandestine campaign of lawlessness and sabotage. On the basis of these activities, the Additional Inspector-General of Police, Special Branch, recom-1 mended that the period of detention be extended and the learned District Magistrate extended the period of detention till 24- 4-78. The District A Magistrate had rightly passed the second order of detention and I find no material or substance to interfere with the impugned order. It cannot be held that the order of detention had been passed without lawful authority.
