' A case under section 148/307/149, P. P. C. Was registered against the nine petitioners and Sajawal Shah for causing injuries to Saidan Shah and others of the complainant party in prosecution of the common object of an unlawful assembly formed by them on the 28th July 1977 on a long-standing dispute about the possession of some land.
2. Saidan Shah, who had suffered a solitary blow on his head at the hands of Sajawal Shah died later so the case was altered to that under sections 148-302/149-307/149, P. P. C.
3. None of the nine petitioners had caused any injury to Saidan Shah (deceased), but they were alleged to have attacked his companions resulting in simple blunt weapon injuries to them.
4. They had moved the Sessions Judge for their release on bail which request was refused, hence the petition.

It was urged that there was no intention to commit the murder of any one of them otherwise Saidan Shah was at their mercy after his fall with a single blow but no one had touched him indicating a clear intention to spare his life. A notice was, therefore, issued to the State and I have heard the counsel of the parties and perused the record which has disclosed that the companions of the deceased had caused three injuries to Qurban Shah petitioner and eight injuries including one grievous to Sajawal Shah (not a petitioner) which is likely to change the complexion of the entire occurrence. The nine petitioners are in judicial lock-up for about six months now and the counter-version is still under investigation as the challan has not so far been put up in Court so without prejudice to the case of either party I admit all the petitioners to bail and direct that they shall be released from custody on their furnishing a bond each in the sum of Rs, 10,000 (Rs, Ten thousand) with one surety each in the like amount to the satisfaction of the Assistant Commissioner, Jhelum.
