DECISION ' This is an appeal against the order of the Labour Court dismissing the application made under section 25-A, L R.

2. The appellant was in the permanent employment of the respondent. He attained the age of 55 years.. According to rules an extension up to 60 years could be granted subject to fitness certified by the Medical Board. The appellant was examined by the Medical Board and he was not found fit.

Consequently, he was retired from service. Aggrieved by this, he approached the Labour Court.

3. The application was resisted on the ground that he had attained the age of 55 years and according to the Medical Board he was not fit to perform his duties any longer. So he was retired according to the rules.

4. The learned Presiding officer, on the assessment of the evidence, accepted the contention raised on behalf of the respondent. The plea of the appellant that tie medical officer was annoyed with him on account of his earlier refusal to do his private work, was rejected by the I about Court and 1 see no reason to take a different view.
