1. Deferred. The applicant is directed to supply the copy of the application to the O.A. And petitioners 2 and 3. The permission in terms of section 316 is granted to applicant, Messrs The Bank of Khyber to proceed with the Suit No, 9 of 1999 pending before the Banking jurisdiction of Peshawar High Court subject to the condition that in case of decree, it would not be executed unless the permission is obtained in terms of section 316 of the Companies Ordinance.
