ORDER

1. ' It has been alleged by Muhammad Amin that he suspected Zafar petitioner and others for setting his shop on fire due to bad blood. The learned counsel for the State has conveyed information that statements of Butt Ali, Muhammad Iqbal and Muhammad Islam ware recorded by the Police the same day under section 161, Cr. P. C. Wherein they stated that they had seen the petitioner and his co-accused running away from the spot of occurence. This fact has been mentioned in the F. I. R.

2. And in case they had seen the petitioner and his co-accused running from the spot of occurrence, they would have conveyed information to the complainant and this fact would have been mentioned in the F. I. R. Since no person saw the petitioner and his co-accused setting the shop on fire and it was not recorded in the F. I. R. That Bash Ali, Muhammad Iqbal and Muhammad Islam P.

3. Ws. Had seen the petitioner and his co-accused running away from the spot of occurrence. 1 admit the petitioner to bail in the sum of R. 5,000 with one surety in the like amount to the satisfaction of A.
