ORDER

' Mr. Awan Muhammad Hanif counsel for the petitioners prays the grant of bail to Muhammad Tufail on the ground of tender age. He states that according to the school leaving certificate the date of birth of Muhammad Tufail petitioner is 7-1-1960. The occurrence in this case took place on 6-3- 1975. According to his calculation this petitioner on the day of occurrence was 15 years and 2 months old. According to him this petitioner is entitled to bail under the proviso to section 497, Cr. P.

C.

2. Mr. Islamul Haq the learned counsel for the State opposes the grant of bail on the ground that earlier bail was refused even by the Supreme Court. He is however not in a position to deny the assertion of the petitioner regarding his age. crlIA

3. Without expressing any opinion on merits, I enlarge the petitions Muhammad Tufail on bail in the sum cf Rs, 5,000 (Rupees five thousan only) with two sureties each in the like amount to the satisfaction of Assistant Commissioner, Okara.
