' An appeal has been filed by Muhammad Tufail workman Sadiqabad Textile Mills Limited, Khanewal Road, Multan against the order of the Learned Junior Labour Court Multan, dated 19th November 1974, whereby he was re-instated in service without any order as to the payment of his back benefits. He has come up in appeal for the award of his back wages. He was terminated as a result of alleged resignation on 25th September 1974. He is entitled to get the wages for the intervening period by reason of his termination having been held by the learned Lower Court on an in genuine basis. It was held under the impugned order that the appellant was terminated without any genuine resignation. No appeal has been filed by the art management to challenge the re- instatement ordered in favour of the appellant. The resignation having been held as unreal, the appellant becomes entitled to the back wages for the intervening period of his unemployment. The appeal is accepted.
