ORDER

Statement has been filed by learned Legal Advisor a look thereon explain absence of the petitioner as well as the counsel today. As per report prepared by Account Officer not only petitioner has A managed to run away with entire amount of gratuity which is Rs,76,757 but the accumulated pension amount of Rs,62,535 has also been taken away by her. The only amount at the moment available in the pension account in Rs,1676.25. Said amount is to be paid to Nadeem Ahmad son of Naseem Ahmad Khan and till further orders passed either, by this Court or by Court of learned Civil Judge who is being directed to conduct inquiry into this matter to the said Nadeem Ahmad son of Naseem Ahmad Khan.

2. I find that the conduct of petitioner is gross contravention the order of the learned Civil Judge and of the terms granting succession certificate.

3. A copy of the writ petition as also the several orders passed on the daily order sheet including present order be sent to learned Senior Civil Judge, Lahore who would summon the record of the succession Certificate Case No,6/5 of 1993 titled Mst. Shaheen Akhtar v. Public at Large decided on 18-5-1993 by Mr. Manzoor Ahmad, Civil Judge, Lahore. The learned Senior Civil Judge shall summon the concerned parties including Mst. Halima Bibi and make an inquiry as to whether the terms of the order granting certificate have been violated and if so by whom and in what manner and also to take steps to remedy the breach committed of the order of the learned Civil Judge granting certificate and the terms of certificate itself. The inquiry be completed before 31-3-2000 under intimation to the Deputy Registrar (Judicial) of this Court. Disposed of.
