1. ' This order shall dispose of two Petitions Nos. 1071/B and 1325/B of 1977. In one there are ten petitioners seeking pre-arrest bail and in the other there is one praying for post-arrest bail. In all there are 16 persons accused in this case of offences punishable under sections 307 and 148 read with 149, P. P. C. The remaining five have already been admitted to bail by the Sessions Court.
2. The incident is admittedly a sequel to the recent National Assembl Elections. According to the prosecution the accused persons attacked and injured the complainant party because the latter had refused to vote for th P. N. A. But according to the defence, the members and sympathisers of the P. N. A. Had taken out a procession on 22-3-77 which procession the persons belonging to the opposite-party tried to disperse as a result of which there was an exchange of brick bats between the two groups. Seven persons from the complainant side sustained injuries while two from amongst th accused were also injured, one of them being Ghulam Rasul petitioner who is A said to be an old man of 70.
3. ' From these assertions it is clear that this is a case which requires a thorough unbiased further inquiry and, until a dependable conclusion is arrived at, the petitioners are entitled to remain on bail.
4. ' I, therefore, confirm the pre-arrest bail granted to ten of the petitioners on the 31st of March, 1977 and admit Ghulam Rasul petitioner to bail in the sum of Rs. 5,000 with one surety in the like amount to the satisfaction of( the S. D. M/Duty Magistrate, Muzaffargarh.
