!JAZ AHMAD CHAUDHRY, J.--- Through this Constitutional petition the petitioners have challenged the impugned order dated 16.10.2001 passed by Zila Nazim, Mianwali, by which they have been transferred by him.
The brief facts of the case are thatpetitioner No. 1, Malik Faiz Muhammad is a District Education Officer (Male) Mianwali, while petitioner No. 2, Mrs. Safia Ahmad Khan, is the District Education Officer (Female), Mianwali whereas petitioner No. 3, Haji Yar Muhammad is the Assistant Education Officer (PE), DE Office, Mianwali. They have been transferred by respondent No. 1 vide the aforesaid impugned order.

Learned counsel contends that even according to the District Government Rules of Business, 2001, District Nazim has no authority to transfer the officers below the rank of Grade-19, The petitioners can be transferred by the DCO and not by respondent No. 1. The order passed by respondent No. 1 is without lawful authority, without jurisdiction and is liable to be set aside by this Court in writ jurisdiction. Relies on "NLR 2000 Service Page 114."
4. I have heard the learned counsel for the petitioner at length and also perused the documents attached with this petition. Admittedly the petitioners are eivil servants and the transfer order has been challenged through this writ petition. In Zahid Akhtar's case reported in "PLD 1995 SC 530" it has been held that oven if the order is without jurisdiction, coram non judice and with meta fide intention can only be challenged before the Punjab Service Tribunal and the High Court has no jurisdiction to entertain such like petitions due to the bar contained in Article 212 of the Constitution of the Islamic Republic of Pakistan, 1973.
