1. Petitioner through this Constitutional petition has taken exception to the notice dated 3-11-1999 issued by respondents Nos,1 and 2 calling upon him to pay an amount of Rs,3,99,840 . Learned counsel has stated at the bar that the petitioner took 42 bags of fertilizer for an amount of Rs,23,500 in the year 1996 as reflected from Annexure. Learned counsel has further stated but the receipt thereof is not traceable. According to learned counsel the petitioner is ready and willing to liquidate his liability provided his case is considered strictly within the four corners of law by the respondent functionaries.
2. I have considered the contentions. The issue subject-matter of this Constitutional petition has emanated out of an agreement executed between the parties on their own volition as such jurisdiction of this Court under Article 199 of the Constitution would not be attracted. However, since the petitioner is ready and willing to liquidate his entire liability, as such. I dispose of this writ petition with the direction to the petitioner to approach respondents Nos,1 and 2 on 10-3-2000 and the latter shall consider his case sympathetically and determine his liability in accordance with law and rules read with terms and conditions of the agreement. Till determination which of course would be made expeditiously. The petitioner shall not be harassed. Writ petition disposed of.
