' MIAN SAQIB NISAR, J.-Appellant filed a suit for the recovery against the respondents under the provisions of the Banking Tribunals Ordinance, 1984. The suit has been disposed of without awarding the appellant the markup, the liquidated damages and the costs of the suit.
2. Learned counsel for the appellant contends, that the Court below, has erroneously refused the above relief to the appellant.
3. We have heard the learned counsel for the appellant. None represents the respondents. In fact, in the present case, the respondents, had deposited the loan amount of Rs, 2.63,400 in the Court; in the circumstances, as the appellant, was left with no cause of action, resultantly. The Tribunal below, had rightly refused the liquidated damages as also the costs. As regards the mark- up is concerned, we are not satisfied, if in such circumstances of the case, the appellant, was entitled to the grant of the mark-up. Resultantly, this appeal has no force and is hereby dismissed.
