IFTIKHAR HUSSAIN CHAUDHRY, J.- Criminal case FIR No. 817, dated 31.12.1.999 under Section 302/109, PPC was registered at Police Station Chak Jhumra, District Faisalabad on the report of Lambardar of Chak No. 111/JB. The Lambardar had found the dead-body of unknown person near bridge of a Minor who apparently was shot to death and thereafter reported the matter to police.
2. In the subsequent, investigation conducted by Sadiq Ali and Tanvir Ahmad petitioner were found as involved in the case. Petitioner was arrested and has applied for grant of bail to him.
3. Learned counsel for the petitioner as well as State have been beard and record perused.
4. The material on record against the petitioner consists of extra judicial confession having made by the petitioner before Khalid Mehmood and Nasir Mehmood on 16.1.2000 and recovery-of a purse, identity card and muffler-scarf, from the possession of petitioner which statingly belonged to the deceased. According to investigation, the role which the petitioner had played in the course of incident was that he had assisted his co-accused Sadiq Ali who statingly had fired at the deceased at the instance of Mst, Nasreen. Petitioner had neither shot at the deceased nor had caused any harm to him and as such his case is. Considered to be that of further inquiry. The petitioner is allowed bail in the sum of, Rs.50,000/- with one surety in the like amount to the satisfaction of Trial Court.
