ORDER

MAULVI ANWARUL HAG, J. Petitioner filed nomination papers to, contest election to the seat of Nazim and Naib Nazim in Union Council No. 2 (Thata Musa, Gujrat). The nomination papers were rejected by the Returning Officer on the ground that Syed Bashir Hussain Shah, the seconder has not signed the nomination papers. Appeal filed by the :petitioner has been dismissed by the learned, appellate authority, or 10.3.2001. Said Syed Bashir Hussain Shah (ID Card No. 225-89-049647) is present in person and has also been identified by the learned counsel under the instructions of his client Syed Abul Hassan. Syed. Bashir Hussain Shah states that he omitted to sign the nomination papers but he was present when the papers were being scrutinised and the appeal was being heard and that he. Had always been ready and willing to sign the papers. Further states that the omission to sign the nomination papers by him was inadvertence.

In this view of the matter the writ 'petition is allowed with a direction to the petitioner and his said seconder to approach the learned returning officer who shall obtain signatures of Syed Bashir Hussain, the said seconder on the nomination papers and Shall proceed further in accordance with law. revisions by the competent authorities.
