MIAN SAQIB NISAR, J.--- Petitioner obtained loan amounting to Rs.75,000/- from respondent No. 4 and claims to have paid Rs.37,000/- and assures willingness to pay Rs.38,000/-, the balance of the principal amount. However, it is stated that according to the tenets of. Islam, the petitioner cannot be made liable to pay the interest. I am afraid, this contention has no force. At the time when the loan was obtained, the petitioner was conscious that he had to pay -the interest. He has utilised the loan amount. He is bound by the terms pf the contract. Thus, there is no illegality in the demand of the interest. The challenge to the provisions of Section 23 of the Small Business Corporation Act, 1972, as also the relevant terms of the contract has been made. I have not-been shown any illegality. It may be observed that if the petitioner is entitled to any incentive of the State Bank of Pakistan, he can apply to the concerned authority/forum and the matter shall be duly considered in accordance with law. Disposed of.
