ORDER SHAHZAD HASSAN PERVEZ, MEMBER (JUDICIAL-I)- Brief facts of the case are that Muhammad Younus, petitioner is Lambardar of Chak No. 113/9-L, Tehsil and District Sahiwal. In this capcity, he had \has acres of land on lease with him. Subsequently, this land was included in the schedule of Livestock Breeding Scheme and remained on lease with the petitioner. The petitioner failed to pay lease money in the year 1996 whereupon he was directed to pay Rs. 1000/- within one month vide order of District Collector dated 12th August, 1996. After expiration of the period of one month, as given in the order of District Collector, the lease was resumed in favour of the state. Against this order dated 12th August, 1996, the petitioner submitted art appeal which was dismissed vide order of Additional Commissioner (Consolidation), Multan Division, Multan. Hence this revision petition.

It is contended by learned counsel for the petitioner that the petitioner is Lambardar of the state and has been performing all the functions and obligations which are vested in or enjoined on him by the rules. He is willing of pay all the outstanding amount. It is prayed that the impugned orders of District Collector and Additional Commissioner may be set aside and lease of the subject land may be allowed to be retrained by him.

3. The petitioner in his capacity as Lambardar performs functions on behalf of the state. The village officer ought to be vigilant of his obligations. His failure to pay lease money in respect of the grant which he has in his possession as Lambardar of the state could be viewed seriously. But, the breach I am inclined to hold, is rectifiable. In this view of the matter, he is directed to pay all the outstanding amount to be reckoned by Colony Assistant, Sahiwal within a period of one month from the date of passing of this order. It is directed that challan enabling the petitioner to deposit the amount will be prepared and given to the petitioner within a period of one week from the receipt of this order.
