ORDER

Learned counsel contends that on 8-5-2000 Ghulam Abbas and M. Waris entered the house of the petitioner and stole away a licensed Rifle (8 mm) alongwith other articles and his continuous supplications finally resulted in registration of a case vide first information report bearing No.430 of 2000, dated 6-8-2000 and another F.I.R. Bearing No.417 of 8-8--2000 was lodged under the Arms Ordinance. However, one of the accused named Waris has not been arrested as a result of connivance with the S.H.O. And A.S.I. Of Police Post Rasool. Entries of the petitioner before S. H. O.

Police Station Sadar Mandi Baha-ud-Din proved abortive as the police officials insisted and taking oath or nian to the effect that the rifle was recovered from the house of Ghulam Abbas.

2. Petitioner shall appear before Superintendent of Police, Mandi Baha-ud-Din who shall listen to his grievance and if after probe it is found correct that the Investigating Officer is taking sides he shall not hesitate to transfer investigation of the case to an officer of independent repute.

3. With these observations, writ petition stands disposed of.
