' This is an appeal preferred against an order dated 28th October 1975, passed by the learned Presiding Officer, Junior Labour Court, Rawalpindi, on a petition made to that Court for re- instatement by the respondent. Petition was accepted. Hence Management has come in appeal.
2. Respondent is a conductor. He had not issued tickets to 2 passengers when checking was made.
At the same time he had not charged the passengers , This is not a misconduct There is nothing on file to show that he had the intention to deprive the Management of any amount.
3. In that view of the matter I do not see any force in the appeal of the Management, uphold the order of the Junior Labour Court, and dismiss the appeal.
