1. ABDUR RAHMAN KHAN, J.-- All the Courts have concurred in dismissing the suit of the plaintiff/petitioner on the ground that he has failed to comply with the requirement of Talab-e- Muwathebath. The learned counsel was unable to dislodge any of the reasons enumerated in the impugned judgments for holding that "Talab" had not been made in accordance with law., Learned counsel in the end stated that this petition be heard alongwith an appeal arising from CP-725-L/96 captioned as "Mst. Waziran alias Faiz Ellahi vs. Abdul Sattar etc." as identical points are to be determined in the said appeal. However, we went through the leave granting order and find that, that case has nothing similar with the present case and the decision in that would have no bearing on the discussion of this case. Therefore, leave is refused and the petition is dismissed.
