1. ' Petitioner has filed this petition under section 25-A alleging therein that he joined the service of respondent establishment in 1971 as a bearer and he was dismissed from service on 25-6-1976 by verbal orders.
2. ' Notice was issued to the respondent. Proprietor of the respondent establishment filed its written reply. Petitioner has examined himself as his own witness whereas proprietor has examined himself on behalf of the establishment.
3. ' Contention of the respondent is that petitioner has no right guaranteed by law as the number of workers in the respondent establishment has never risen to 15. Petitioner has filed a list of 24 workers who according to him were working at the time or had worked in the establishment within a period of 12 months, preceding to his alleged termination. I need not have to give any finding on this fact when it has been admitted by the petitioner that he left the establishment on 1st June, 1976 and when he has further admitted that he remained for 2 months at Karachi. Fact of his verbal termination 25-6-76 has been contradicted by him. He left the service of the respondent and went to Karachi for better prospects. A letter, copy of which is Exh. R-1, was sent to him on 5.6-76 with a copy to the Labour Department to which he never replied. When he could not find job at Karachi or outside the country, he came back and filed this petition on 10-7-76. In these circumstances no enquiry was required particularly when the claim of the petitioner regarding strength of workers is denied by the respondent. Petition is dismissed.
