ORDER

' This order will be read in continuation of my order dated 17-11-1976 as well as the order of my learned brother Mr. Justice Kamal Mustafa Bokhary, dated 25-11-76.

2. The learned counsel appearing on behalf of the State has vehemently contested the grant of ad interim bail to Gulzar Ahmadtitioner on the ground that he has been assigned definite part in the F.

I. R. For inflicting injuries on the person of Muhammad. Zafar complainant. Therefore, he was not entitled to pre-arrest bail. On the other hand, the learned counsel for the petitioner has submitted that two of his co-accused who have been assigned similar part in the F. I. R. Have been released on bail, therefore the case of the present petitioner would be at least at par with them. With regard to his pre-arrest release on bail the learned counsel has pointed out once again that a case earlier to this was lodged by the petitioner against Muhammad Shaft, brother of the complainant.

Therefore the likelihood of his false implication in this case would not stand excluded.

I have given my anxious thought to the arguments led by both the learned counsel and I find that ample case is made out for confirmation of the bail already granted to the petitioner on the premises so propounded by the learned counsel on his behalf. It has been verified that he did initiate , the criminal proceedings -against the brother of the complainant earlier" to this incident as well as the record of the case does disclose that two of his co-accused have- been granted bail whose part is absolutely similar to the one assigned to him in the F. I. R. In view of this the bail already granted to him is confirmed.
