GHULAM MAIIMOOD QURESHI, J. - It is submitted that the petitioner is complainant of case FIR No 457/1994 under Sections 302/148 and 149, PPC, of P.S. Cantt. Multan, dated 16.11.1994. The main accused in this case is Aneel Ashiq Mattu respondent No. 4. The other co-accused namely Abdul Qayum Bhatti was discharged while three co-accused were acquitted on 15.7.1998 and respondent No. 4 was declared as absconder. Warrants of arrest were issued against him. It is further submitted that since the registration of the case respondent No. 4 is absconding and now the petitioner has come to know that he is residing with his real brother at 38-Jail Road Lahore where the accused is taking refuge. On becoming aware of-the-presence of the absconding accused, the petitioner approached respondents Nos. 1 to 3 with a written application for the arrest of the said accused but no steps have been taken by the respondents for his arrest.
2. Learned Additional Advocate-General. Punjab who is present on Court's call when confronted with this situation submits that the Police Officer/Officials are duty bound to proceed in accordance with law and apprehend the culprits. It is further submitted that he has got nd objection if a direction is issued to respondents Nos. 1 to 3 to arrest respondent No. 4 if he is requirement any criminal case. In view of the statement made by the learned Additional Advocate-General respondents Nos. 1 to 3 are directed to take necessary action for the arrest of respondent No. 4 and produce him before the Court of competent jurisdiction. This petition stands disposed of.
3. Compliance report shall be submitted to this Court through Deputy Registrar (Judl) within a fortnight. The petitioner is directed to assist the police for effecting the arrest of respondent No. 4.
