ORDER

' This is a revision petition filed under section 13 of the Consolidation of Holdings Ordinance, 1960, against the order dated 20-5-1974 of the Additional Commissioner (Cons.), Multan whereby revision petition of the petitioner was dismissed on merits as well as on the point of limitation.

2. Heard and examined the record.

3. The main grievance of the petitioner is that the land in Squares Nos, 26 and 27 which was exclusively owned by him before consolidation has been included in Khata held by him, jointly with the respondents.

4. The record shows that before consolidation the petitioner was in ex-elusive ownership of an area of 74 kanals 19 marks in Khasra Nos, 10 and 11 of Square No, 26, and Khasra Nos, 2, 3, 6, 7, 8 and 14 to 16 of Square No, 27 in Khewat No,

110. The petitioner also holds some land jointly with the respondents in Square Nos, 30, 76 and 86. In consolidation his exclusively owned area of 74 kanals 19 marks in Square Nos, 26 and 27 has been included in the Khata of the respondents in the joint Scheme No, 13 t. This was niether fair nor required by law. His share in the joint holding should have been separated and grouped with the area owned exclusively by him so as to form an independent Khata. I. Therefore, accept the petition and remand t case to the Collector (Cons.) for taking action accordingly after hem necessary parties. {{BLUR PAGE}}
