ORDER

1. ' HAMID ALI MIRZA, J.---Learned counsel for KMC states that in case the respondents Nos.4 and 5 have raised any unauthorised construction over Plot No, 98, Street No,1, Street No,2, Azam Basti, Mehmoodabad, Karachi in violation of approved plan, respondent No,2 will perform their statutory obligations with regard to demolition of unauthorized construction raised in violation of the approved plan.

2. ' The above statement satisfies the learned counsel for the petitioner and states that the petition may be disposed of.

3. The question whether the existing construction is regularized of KBCA or the same is regularizable, would be for KBCA to decide and in case it is so, the demolition/removal work will not be carried out but in case it has not been regularized or could not be regularized according to rules and by-laws, the KBCA would perform its statutory obligation in accordance with rules and by-laws and compliance report will be submitted within two months.

4. ' With the above observations, the petition alongwith the listed application stands disposed of.
