ORDER

' Fateh Muhammad, Jan Muhammad, Muhammad Yusuf, Khusi Muhammad and Muhammad Ashraf petitioners have moved this petition for bail in a case registered against them and their co- accused under sections 1414, 302 and 307 read with section 149, P. P. C. At Police Station Shah Kot, District Sahiwal on 19-4-1975. The facts of the case are detailed in Criminal Miscellaneous No. 748/B of 1976 and need not be reproduced here. The bail is sought on the sole ground of delay.

2. The learned counsel for the petitioners states that the petitioners were arrested in April 1975 and their trial is not in sight so far, therefore, in view of the inordinate delay in the trial they are entitled to the concession of bail.

3. The learned Sessions Judge was asked to submit a report as to when the case was likely to be taken up for trial and he has reported that this case is not shown in the lists and it may be lying still in the Court of th Magistrate. The learned State counsel concedes that in view of this report the trial does not appear to be in sight in the near future. In the circums tances I admit the petitioners to bail in the sum of Rs. 20,000 each with one surety each in the like amount to the satisfaction of Assistant Commis sioner, Sahiwal.
