2. This order would dispose of Crl. Misc. No, 1613/B-77, filed by Ch. Muhammad Siddiq, Advocate, and 135 others, Crl. Misc. No, 1902/B-77, filed by Mohammad Abid Naeem and Crl. Misc. No, 1904/B-77, filed by Saeed Ahmad and 4 others.
3. I have been taken through the F. I. R. Of this case. According to the prosecution version, a mob comprising of about 3000 persons reached near WAPDA Office. The processionists tried to set a truck on fire by means of explosive material. Thereafter, Ali Muhammad petitioner threw a bottle bomb at a truck. An explosion was caused with the result that Asghar Ali Constable received injuries. The other members of the procession pelted stones and also opened fire at the Police party. The Police party was directed to lathi charge the mob. Some processionists received injuries.
Some were apprehended at the spot. The rest succeeded in running away.
4. One hundred and thirty-one persons have been named in the F. I, R. It was not specifically mentioned in the F. I. R. As to which of them was carrying the fire-arms. It has also not been mentioned as to which of the petitioners opened fire at the Police party and pelted stones. There is an allegation of general nature. Ali Muhammad petitioner was responsible for throwing bottle bomb at a truck which exploded and as a result of Th explosion, Asghar Ali Constable received injuries. His case is not fit for bail. His bail petition is dismissed.
All the other petitioners are admitted to bail in the sum of Rs, 2,000 with one surety each in the like amount to the satisfaction of A. C., Lyallpur who shall return the bail bonds to this Court after attestation.
