' This is an application for bail by Asad Ali alias Chenna petitioner who alongwith three others namely ; Atbar Ali, Mohsin Gal and Ghafoor, is accused of an offence under section 302/326/324 read with section 34, P. P. C. The application for bail submitted by the petitioner was rejected by the learned Sessions Judge, Faisalabad, vide his order dated 3-11-1977.

Lodged at the instance of one Muhammad Sarwar, on 21-8-1977, at 10-15 p.m. At Poli xi Station People Colony, Faisalabad, it is alleged that at 7-45 p.m. The same day, the petitioner and the other three co-accused had an altercation with the complainant, Abdul Jabber, Rashed Mahmud, Ghulam Ali and Taib Ali during which injuries were received by Abdul Jabber, Rashed, Mahmud and Ghulam All succumbed to his injuries.

It is contended by the learned counsel for the petitioner that Attar All co-accused was granted bail by the learned Sessions Judge and Mohsin Gul co-accused was granted bail by this Court, side order dat d 15-11-1977, passed in Criminal Miscellaneous No, 4362-B/1977. The cue of the petitioner is at par with the case of Mohsin Mohsin Gul was granted bail on the ground that he did not cause any injury to the deceased but caused only a simple injury to Abdul Jabber P. W. There is no allegation that the petitioner caused any injury to the deceased. He is alleged to have caused a simple Injury to Abdul Jabber P. W.
4. The learned counsel for the State does not seriously contest the application.
After hearing the learned counsel for the parties I am of the view thati it is a fit_case for the grant of bail to the petitioner. There is no allegation that he caused any injury to the deceased. He is alleged to have caused a simple injury to Abdul Jabber P. W. On thigh. His case is not distinguish. Able from that of the case of his co-accused Mohsin Oul, who has already been granted bail by this Court. I, therefore, enlarge petitioner on bail subject to his furnishing bail bonds in the sum of Rs, 15,000 (Rupees Fifteen Thousand only) with two sureties in the like amount to the satisfaction of the.
