ORDER RASHID AZIZ KHAN, C.J.- Notice sent to respondent could not be served as he refused to accept the service. In these circumstances he is proceeded ex parte. Prayer of the petitioner is that respondent's suit for restitution of conjugal rights pending before Judge Family Court, Rawalpindi may be transferred to Judge Family Court, Faisalabad where suit of the petitioner for jactitation of marriage is pending.
2. Pray is allowed. It is directed that suit titled Abid Hussain alias Battee v. Mst. Safiana Shaheen, for restitution of conjugal rights shall be 'transferred to Judge Family Court, Faisalabad and shall be heard along with suit of the petitioner, for jactitation of marriage. Disposed of.
