Petitioner, a student of Ayub Medical College, Abbottabad, applied for migration to Fatima Jinna Medical College, Lahore, on mutual basis on the seat of one Javeria, a student of Fatima Jinnah Medical College. It is claimed that the Principals of the Colleges have already issued no-objection certificates, but respondent No,1 was not approving the migration.
2 Learned Assistant Advocate-General has been seeking time to apprise this Court of the decision of respondent-Government as it was claimed that the matter was under consideration. He has today placed on record the minutes of the Migration Committee held on 1-6-1998 under the Chairmanship of Health Minister, Punjab. This Committee was constituted by the Chief Minister, Punjab to discuss the cases of hardship including that of the petitioner. According to the Minutes, the Committee, after due deliberation, did not approve of the migration as the petitioner had been admitted on self-finance seat, while the said Javeria was admitted on the seat reserved for Azad Jammu and Kashmir. The Committee referred to condition at page 52 of the Prospectus of the Medical Colleges in Punjab in support of its decision. According to the condition, the migration, in such circumstances, of students admitted on special/reserved seats cannot be permitted.
3. Learned counsel for the petitioner has disputed the correctness of the decision. However, he has not been able to rebut the fact that under the Prospectus of the Medical Colleges in Punjab at page 52, it is stated that "Students admitted against reserved seats on various categories will not be allowed migration to other Colleges". The decision of the Punjab Government, therefore, is covered by and has the backing of the rule contained in the Prospectus. Consequently, I hold this petition to be without merit and dismiss it without any order as to costs.
