' This is a revision application under section 38(3-a) of the Industrial Relations Ordinance, 1969, against the order, dated 1 1 th August, 1999, passed by the learned Presiding Officer, Sindh Labour Court No,5, at Karachi.
2. It is submitted that the respondent was retired in the year 1992 from the company and has been receiving the amount of pension. He made an application to the Labour Court for the computation of pension correctly.
3. The applicant management appears to have filed some application for hearing of preliminary legal objections, raised in the reply statement.
4. The learned Labour Court by his order, dated 11th August, 1999 has, inter alia, observed that "the Courts are supposed to decide the cases on merits rather than on technicalities. All aspects of the cases are to be cumulatively taken into consideration and therefore, I think this application is mis- conceived and does not merit any consideration and therefore, it is dismissed accordingly".
5. I think the question of computation requires evidence and proper adjudication. I do not feel inclined to interfere with the impugned order. After all the right of appeal is vested to the appellant.
The superior Courts have been discouraging the decisions in piecemeal. The revision application is dismissed in limine.
