ORDER

TASSADUQ HUSSAIN JILANI, J. -- Learned counsel for the respondent submits that he has no objection to the acceptance of this writ petition provided the petitioner is given the dues for the period he remained in service.

2. The Deputy General Manager, Pakistan Railways, appearing in Court submits that if petitioner files an appeal before him, the same shall be decided strictly in accordance with law and the Railway Department shall also consider his prayer for the grant of dues during the period referred to above.

3. In view of the statement made by learned counsel for the petitioner and the Deputy General Manager, Pakistan Railways, this writ petition is allowed and the order dated 25.8.1994 passed by Wafaqi Mohtasib is set aside. As it is an old matter, I am persuaded to direct the Deputy General Manager, Pakistan Railways, to decide petitioner's appeal within 30 days of the filing of the same under intimation to the D.R. (Judi.) of this Court. Disposed of.
