ORDER

IHSAN-UL-HAQ CHAUDHARY, J. - The brief facts on the grounds of this revision is that respondent No. 3 was owner of the suit land. He firstly sold it to petitioner through 3 sales-deeds and subsequently sold it to respondents Nos. t and 2. The petitioner filed a suit for Declaration. This way the respondent No. 3 has no subsistence interest in the litigation.

2. This is an application for decision of the revision petition in view of the compromise incorporated in the application, according to which the petitioner is agreed to pay a sum of Rs.5,00,000/- to respondents Nos. 1 and 2. Rs.50,000/- was paid at the time of execution of the compromise while the remaining has been paid in Court. The respondents have no objection to the acceptance of this revision petition.

3. The upshot of the above discussion is that the revision is accepted in terms of the compromise incorporated in the application under Order 39 Rule 3, CPC. The judgments and decrees of the two Courts are set aside. The application is accepted. The compromise is proved. The result is that the suit of the petitioner stands decreed with no order as to costs.
