TASSADUQ HUSSAIN JILANI, J. - Seeks bail in a case F.I.R. No. 186, dated 6.7.1998 under Sections 324/148 and 149, PPC, Police Station, Manawala.
2. The prosecution story as given in the F.I.R, registered on the statement of Muhammad Ayub briefly stated is that on the fateful day, his son Abid Hussain was find upon by Zafar Hussain and Mudassar Hussain . He was told this by Nazir Ahmad son of Wallayat Khan and Muhammad Zaheer son of Adrees. The allegation against the petitioners is that they were also present alongwith their co-accused.
3. Learned counsel for the petitioners prays for bail on the ground that no overt act is attributed to the petitioners and that they are not connected with the motive part of the prosecution story.
Learned counsel for the State in all fairness submits that since no role is attributed to petitioners he is not in a position to oppose the prayer for grant of bail.
4. n view of the above, as no overt act is attributed to petitioners and admittedly, they are behind the bar for quite some time and as learned State counsel does not oppose the prayer, 1 am inclined to allow. This petition and direct that the petitioners shall be released on bail in the afore- referred case provided they furnish bail bonds in the sum of Rs.50,000/- (Rupees fifty thousand only) each in the like amount to the satisfaction of Trial Court.
