KH. MUHAMMAD SHARIF, J.- Learned counsel for the petitioner submits that in subsequent investigation, petitioner was declared innocent and was placed in column No.2 of the report.
Moreover, according the F.I.R., no injury was attributed to him.
2. I have gone through the report under Section 173 Cr.P.C., which is on file. According to the report, he was found innocent by D.S.P. Sangla Hill and also D.S.P., Sheikhupura.
3. In this view of the matter, the case of the petitioner does not fall within the prohibitory clause of Section 497(1), Cr.P.C. Petitoner is allowed bail subject to furnishing bail bond in the sum of Rs.50,000/- with one surety in the like amount to the satisfaction of Illaqa Magistrate/Duty Magistrate.
