FALAK SHER, J.- Post arrest bail is being sought in the case registered vide FIR No. 81 of 4.5.1992 under section 382 PPC read with section 17 of the Offence Against Property (Enforcement of Hudood)
Ordinance, 1979, Police Station Syedwala District Sheikhupura urging consistency viz., co-accused with identical role having been allowed bail vide Crl. Misc. No. 6637-B of 1998 on 12.3.1998, in the following terms: - "Petitioners having been arrested in the case registered wide FIR No. 81 of 4.5.1992 under section 382 PPC read with section 17 of the' offences Against Property (Enforcement of Hudood) Ordinance, 1979, Police Station Syedwala District Sheikhupura alleging theft of the within mentioned 42- animals of wide variety conjunctively with the spelt out co-accused variously equipped on 11.4.1992 have sought bail.
'2. Contending to have already suffered 2^2 years internment without commencement of the trial; factum whereof remained uncontroverted by the learned counsel appearing on behalf of the State upon instructions imparted by the police official in attendance equipped with the record.
3. Consequently, granting the request the petitioners are allowed bail upon furnishing bonds in the sum of Rs. 30,000/- each with to sureties each in the like amount to the satisfaction of the trial Court." they to are entitled to the concession.
